BY ADDRESSING THE CEC, UZUNOVIĆ EXCEEDED HER AUTHORITY
SARAJEVO, OCTOBER 21 /SRNA/ - The Head of the SNSD Caucus in the House of Representatives of the BiH Parliamentary Assembly, Sanja Vulić, stated that BiH Court judge Sena Uzunović exceeded her authority when she independently sent a letter to the CEC requesting the enforcement of a ruling against President Milorad Dodik.
Vulić emphasized that she expects Acting President of the BiH Court, Minka Kreho, to urgently clarify whether Uzunović has the authority to act on behalf of the Court or whether this was a self-initiated, vindictive, and inappropriate action that requires a response. Vulić noted that the Appeals Chamber of the BiH Court has already ruled in the case and that it has been legally concluded, but that Uzunović then intervened, attempting to place herself above both the Court and the Appeals Chamber. “An environment of confusion, lawlessness, and inappropriate influence is one in which such individuals operate because they have never been held accountable for their role in the war,” Vulić added. She asks since when an individual judge can assume the role of the BiH Court, reminding that a single judge has no legal or institutional authority to act on behalf of the Court of BiH or to address other institutions publicly in the Court’s name. “The Court has a president and a public relations office, which are solely authorized to represent the institution’s positions,” Vulić said, adding that an individual judge cannot act as an interpreter of a ruling or as a body demanding its enforcement. The Court, she added, issues a ruling, and its interpretation and enforcement fall under the competence of the relevant bodies, not individuals. “Such behavior constitutes a gross overreach of authority and further undermines the already tarnished reputation of the judiciary. The Court of BiH is not, and must not be, a private platform for individuals to convey political messages or personal interpretations of court decisions,” Vulić emphasized.
