"SCHMIDT'S LAW" IS NOT PART OF BiH'S LEGAL SYSTEM

BANJA LUKA, JUNE 1 /SRNA/ – Christian Schmidt violated all the legal acts he cites in his decision amending the Criminal Code of BiH, and therefore that "Schmidt law" is not and cannot be part of the country's legal system, and for that reason, all of its consequences should be annulled if there is any desire to preserve BiH in any form, legal expert Slavko Mitrović wrote in a column for the newspaper Glas Srpske.



He recalled that a request for a constitutional review of provisions of the Criminal Code of BiH imposed by the self-proclaimed High Representative Schmidt is currently before the judges of the Constitutional Court of BiH. "That request, submitted by the SNSD parliamentary caucus, was filed on December 11 of last year, but there is still no sign of any action being taken, which was confirmed on May 15 this year by Mirsad Ćeman, the retired president of what remains of the Constitutional Court of BiH," Mitrović stated. He stressed that he has no illusion that any constitutional ruling could emerge from the Constitutional Court regarding the legal irregularities and crisis caused by Schmidt's unlawful actions. "Why do I have no such illusion? Because at a press conference held on May 15 this year, Constitutional Court judge Larisa Velić recalled that the Court had already taken the position in 2000 that it has no jurisdiction to review the powers of the High Representative, although it may assess the constitutionality of laws enacted by the High Representative," Mitrović added. He concluded that the time has come for the rule of law, warning that it could soon be too late.
